A few initial considerations must be made in order to describe early childhood services in Brazil in the larger context of the childs situation in the Brazilian legislation. The 1988 Constitution inaugurated a period of progress in terms of human rights in Brazil. For the first time, a Brazilian Constitution referred specifically to childrens rights as something apart from the rights included in the area of Family Rights. In article 227, the Constitution recognizes a wide-ranging body of rights pertaining to all children and adolescents. Subsequent legislation incorporated these rights.
